The dependency exemption is negotiable and often unaddressed. It belongs to the custodial parent by default and can be released to the other parent by written form. Agreements silent on the point produce an argument every filing season. The basic calculation is not the whole obligation. Health insurance, unreimbursed medical costs, child care, and educational expenses are apportioned separately in proportion to income, and in many cases exceed the basic award. The formula runs to a statutory income cap, adjusted periodically, above which the court exercises discretion. Modification has three routes. A substantial change in circumstances, three years since the last order, or a fifteen percent change in either parent's income — the second and third requiring no separate showing, unless the order opted out of them.Arrears are not reduced retroactively. Relief runs from the filing date, not from when circumstances changed.
