Business method patents and utility patents are not alternatives to choose between. A utility patent is a statutory patent type; a business method describes what the invention is about. There is no separate statutory category for business method patents, and an application claiming a commercial process or system is examined as any other utility application. Eligibility is where these applications fail most often. Under Alice Corp. .. CLS Bank International, 573 U.S. 208 (2014), the examiner asks whether the claim is directed to an abstract idea and, if so, whether it recites significantly more than that idea implemented on a generic computer. Automating what people already did by hand does not supply that something more. Claims drawn to a specific technical improvement fare better than claims drawn to the commercial result. Novelty, non-obviousness, and written description under §§ 102, 103, and 112 apply in the ordinary way, and Section 14 of the America Invents Act treats tax strategies as within the prior art. Post-grant options have narrowed. The Transitional Program for Covered Business Method Patents sunset on September 16, 2020. Eligibility under § 101 can be raised in post-grant review, which must be filed within nine months of issuance, but not in inter partes review — after that window, a § 101 challenge belongs in litigation. Trade secret protection runs the other way: a patent is granted in exchange for disclosure, while a trade secret lasts as long as the information stays secret. For a method competitors cannot observe from the product, secrecy may outlast a twenty-year term. Claims arise under the Defend Trade Secrets Act and, in New York, under common-law misappropriation.
